1.Who we are and what these terms cover
DatumDesk (“DatumDesk”, “the service”, “we”, “us”) is operated by BuildCentral. These Terms of Service (“Terms”) form a binding agreement between you and BuildCentral. If you use DatumDesk on behalf of an organisation, you confirm you are authorised to bind that organisation to these Terms.
Our Privacy Policy explains how we handle your personal information and forms part of these Terms.
2.The service
DatumDesk lets registered users ask questions about the National Construction Code (NCC), state and territory variations, and the Australian Standards those documents invoke, and returns answers with citations to source material. The service is intended for Australian built environment professionals.
3.Eligibility and accounts
You must be at least 18 years old and capable of forming a binding contract. You are responsible for the accuracy of the information you provide, for all activity under your account, and for keeping your sign-in credentials secure. Tell us promptly at support@datumdesk.ai if you suspect unauthorised use of your account.
4.Free trial
New paid subscriptions begin with a 14-day free trial unless stated otherwise. We collect your payment details at sign-up but do not charge you during the trial. If you do not cancel before the trial ends, your subscription automatically converts to a paid plan and we charge the then-current price for your selected billing period.
You can cancel at any time before the trial ends through the billing portal, and you will not be charged. Trials are intended for first-time subscribers and we may decline or withdraw a trial where we reasonably believe it is being misused.
5.Subscriptions, billing and cancellation
Paid plans are billed in advance on a recurring monthly or annual basis through our payment processor, Stripe. Prices are shown in Australian dollars and, unless stated otherwise, are inclusive of GST where applicable.
- Your subscription renews automatically at the end of each billing period until you cancel.
- You can cancel anytime; cancellation takes effect at the end of the current paid period and you retain access until then.
- Except where required by law, payments already made are non-refundable and we do not provide pro-rata refunds for partial periods.
- We may change pricing on reasonable notice; changes apply from your next renewal, never mid-period.
Nothing in these Terms limits rights you have under the Australian Consumer Law, including guarantees that cannot lawfully be excluded.
6.Acceptable use
You agree not to:
- Use the service in breach of any law or third-party right;
- Share your account, or resell or redistribute answers as a competing compliance database;
- Attempt to access the service’s systems, other users’ data, or our source corpus without authorisation;
- Scrape, bulk-export, or use automated means to extract content beyond normal individual use; or
- Interfere with, overload, or disrupt the service.
7.Professional reference only — not compliance advice
DatumDesk is an information and research tool. Its answers are generated by automated systems from a corpus of source material and are provided for professional reference only. They are not certification, building approval, or professional advice, and they do not replace the judgement of a registered building surveyor, certifier, engineer, or other qualified professional.
You are responsible for independently verifying every answer against the current, operative version of the NCC and any applicable state or territory variation for your jurisdiction before relying on it. The operative edition of the NCC differs by jurisdiction and changes over time. We do not warrant that any answer is complete, current, or fit for a particular project.
8.Intellectual property
We and our licensors own the service, its software, and its presentation. We grant you a limited, non-exclusive, non-transferable right to use the service for your own professional purposes while your account is active. Source materials such as the NCC and Australian Standards remain the property of their respective publishers; your responsibility to hold valid licences to those documents is unaffected by your use of DatumDesk.
9.Disclaimers and limitation of liability
To the maximum extent permitted by law, the service is provided “as is” without warranties of any kind, and we exclude all implied warranties. Where liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the service or paying the cost of having it re-supplied.
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, or for any loss arising from reliance on an answer that was not independently verified. Our total liability for any claim is limited to the amount you paid us for the service in the 12 months before the claim arose.
10.Suspension and termination
You may stop using the service and close your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the service or other users. On termination, your right to use the service ends; sections that by their nature should survive (including disclaimers, liability limits, and intellectual property) continue to apply.
11.Changes to these terms
We may update these Terms from time to time. If we make material changes we will take reasonable steps to notify you, for example by email or an in-app notice. Continued use after changes take effect means you accept the updated Terms.
12.Governing law
These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that place.
