Ten regulatory calls architects get pushed on, and the clause behind each one

On Class 2 to 9 work the pushback arrives with a signature attached. A builder wants to substitute the balcony membrane and asks you to initial it. A landlord says the fitout can rely on the base building toilets. The acoustic consultant and the client want different bedroom windows. Each of those is a question with a clause behind it, and the clause decides who is carrying the liability.

These are ten real questions architects asked DatumDesk, answered with the verdict, the clause and the page. They reach into the Design and Building Practitioners Act, the Queensland Development Code and the bushfire planning rules as well as the NCC, because on your jobs the answer is rarely in one document.

Swapping a waterproofing detail on site is a variation to a regulated design under the DBP Act.

This is the one to get right, because under the Act the liability is personal. Waterproofing is a building element, so a swap on site is a variation to a regulated design, not a site instruction. Before the varied work starts a registered design practitioner must prepare the varied design and a fresh design compliance declaration must be obtained, and the builder carries the duty to make that happen. Do not initial the substitution. Point at section 20.

NSWClass 2NCC 2022 (with the Design and Building Practitioners Act 2020)
The questionWe are the architects on a three-storey apartment building in Parramatta. The builder wants to swap our balcony waterproofing detail for a cheaper system on site. Under the Design and Building Practitioners Act, does that need a new regulated design, and who has to declare it?

The answer. Yes. Waterproofing is a building element under the Act, so the swap is a variation to a regulated design: before the varied work starts, a registered design practitioner must prepare the varied design and a fresh design compliance declaration must be obtained, and the builder carries the duty to make that happen.

Sixty office staff need a specific count of fixtures, and relying on the floor below is a separate question.

Sixty staff is a number, and the NCC turns it into fixtures: on a 30 and 30 split, two pans, two urinals and a basin for men, two pans and a basin for women, and an accessible unisex compartment on every storey with sanitary compartments. Whether the floor below can supply that count is a separate question, and the surveyor should tie it to a named clause rather than an instinct.

    VICClass 5NCC 2025
The questionThe landlord says our Melbourne office fitout for 60 staff can rely on the base building's toilets a floor below. The building surveyor isn't convinced. How many sanitary facilities does a Class 5 tenancy need?

The answer. On a 30 and 30 split, 60 staff need 2 closet pans, 2 urinals and 1 washbasin for men and 2 closet pans and 1 washbasin for women, plus an accessible unisex compartment on every storey with sanitary compartments. Whether the base-building toilets a floor below can supply that count is a separate question the surveyor should tie to a named clause.

A DA lodged in one edition window and a BA in the next is an edition question with a date on it.

Lodgement dates decide editions. A DA lodged in the ACT before 1 November 2026 keeps the either-edition election, so NCC 2022 can still be nominated even where the building approval issues after 1 May 2027, for as long as the DA lives. That is the certifier being right, with a date you should write on the cover sheet. Adoption differs by state, so confirm with your state building authority.

    ACTClass 2-9NCC 2022 (either-edition window to 2027)
The questionOur Canberra project's DA was lodged in October 2026 but the building approval won't land until mid-2027. The certifier says we can still choose NCC 2022. Is that right?

The answer. Yes: a DA lodged before 1 November 2026 keeps the ACT either-edition election, so NCC 2022 can still be nominated even where the building approval issues after the 1 May 2027 mandatory-NCC-2025 date, until the DA expires.

In a Queensland noise corridor, bigger bedroom windows can push the glazing up a band.

Window size changes the glazing band. At Noise Category 2 a habitable room needs Rw 32 while its total glazing is 1.8 square metres or less, and Rw 35 once it goes over. Bigger bedroom windows are a design choice. The acoustic consultant's revised specification is the price of it.

    QLDClass 1NCC 2022 (with QDC MP 4.4)
The questionOur Brisbane infill site is mapped as noise category 2 under the transport noise corridor rules. The acoustic consultant has specified glazing, but the architect wants bigger bedroom windows. What ratings does the envelope need, and does window size change the glazing requirement?

The answer. Yes, window size matters. At Noise Category 2 the glazing to a habitable room needs Rw 32 while the room's total glazing is 1.8 m² or less, and Rw 35 once it goes over 1.8 m², so bigger bedroom windows can push the specification up a band.

At BAL-FZ in NSW the deemed-to-satisfy route is closed, so a performance solution is the path, not the escape.

Flame zone is not a stop sign, but in New South Wales it closes the deemed-to-satisfy door. A performance solution is the pathway, not an escape from the requirements, and it still has to be built on AS 3959 and the NASH Standard. Price the solution before the client falls in love with the site.

NSWClass 1NCC 2022 (with Planning for Bush Fire Protection 2019)
The questionOur client's site assessment came back BAL-FZ. Is building even feasible at flame zone rating, and can a performance solution get us away from the deemed-to-satisfy requirements?

The answer. Building at BAL-FZ is feasible, but in NSW the deemed-to-satisfy route is closed at the flame zone, so a performance solution is the pathway rather than an escape from it, and it should still be built on AS 3959 and the NASH Standard.

External stair treads need P4 or R11, and a rated nosing strip is a genuine alternative.

An external timber stair is a wet surface, so treads need P4 or R11 to AS 4586. A tested nosing strip rated P4 is a genuine alternative to treating the whole tread, but only if the strip itself carries the classification. Ask the supplier for the test report, not the brochure.

    VICClass 1NCC 2025
The questionThe building surveyor flagged the timber stair off our Geelong deck for slip resistance on the treads and nosings. What classification do external stair treads need, and does a nosing strip get us out of treating the whole tread?

The answer. The surveyor is right to raise it. A stair exposed to the weather is a wet surface, so treads need P4 or R11 when tested to AS 4586. A tested nosing strip rated P4 is a genuine alternative to treating the whole tread, but the strip itself must carry that classification.

Roof lights need 900 mm from a separating wall or boundary, and together no more than 20 per cent of the roof.

Three skylights in a roof that runs to the party wall is a fire separation problem. A combustible roof light needs 900 mm from the vertical projection of the separating wall and 900 mm from a side boundary, and together they can take no more than 20 per cent of the roof. Move one or lose one.

    SAClass 1NCC 2022
The questionOur Adelaide terrace design has three skylights in a roof that runs to within a metre of the party wall, and the certifier has raised fire separation. How close to a boundary or separating wall can a roof light sit, and how much of the roof can they take up?

The answer. The certifier is right to raise it. A combustible roof light must sit at least 900 mm from the vertical projection of a separating wall and 900 mm from a side boundary, and all the roof lights together can take up no more than 20% of the roof or part of the roof.

On reactive clay, articulation joints are mandatory, and the wall sets the spacing, not the soil.

The engineer is right, and the reason is not the one people assume. On reactive clay the joints are mandatory because the only exemption is for soil classes A and S. The spacing is set by the wall, not the soil: six metre centres without large openings, five where openings exceed 900 by 900, plus joints at specific changes in the wall.

    SAClass 1NCC 2022 (NCC 2025 from 1 May 2027)
The questionOur Adelaide brick veneer house on a reactive clay site has long unbroken walls, and the engineer flagged articulation joints. How far apart do articulation joints need to be in masonry veneer, and what sets the spacing?

The answer. The engineer is right. On a reactive clay site articulation joints are mandatory, because the only exemption is for soil classes A and S. Spacing is not set by the soil class: it is set by the wall, at not more than 6 m centres for walls without large openings and not more than 5 m centres where openings exceed 900 mm x 900 mm, plus joints at specific changes in the wall.

The step-free entry exemption has two limbs, and you need both.

The step-free exemption on a sloping block has two limbs and you need both: no step-free route via a garage, carport or parking space, and a site condition such as an average slope steeper than 1:14. It only switches off the access path clause. The rest of the Livable Housing Design Standard still applies.

ACTClass 1aNCC 2025 (electable in the ACT to 30 April 2027)
The questionOur sloping Canberra block makes a step-free entry very hard. The certifier mentioned the livable housing provisions have an out for exactly this. When is step-free entry required and what relief exists?

The answer. The certifier is right that there is an exemption, but it has two limbs and you need both: no step-free route via a garage, carport or parking space, and a site condition such as an average slope steeper than 1:14. It only switches off the access path clause; everything else in the Livable Housing Design Standard still applies.

Hot water at a bathroom fixture is capped at 50 degrees, and 45 in aged care, health care and schools.

Fifty degrees at a standard bathroom fixture, forty-five in aged care, health care, schools and other high scald-risk settings. In South Australia plumbing is already on NCC 2025, so this is a Volume Three question in the current edition even while the building work sits on 2022.

    SAAll classesNCC 2025
The questionWhat is the maximum hot water delivery temperature at a bathroom basin or shower?

The answer. Heated water must be delivered at no more than 50 °C at a standard bathroom fixture, dropping to 45 °C in aged care, health care, schools and other high scald-risk settings. In SA this is already an NCC 2025 question.

The pattern

What these have in common.

Six of the ten reach past the NCC into an Act, a Code or a planning instrument. That is the shape of Class 2 to 9 work now. The clause you need is often in the document the builder has not read.

The practical rule is the same as it is for the building designer down the corridor: before you sign, substitute or concede, have the clause open. Under the DBP Act in particular, the signature is the liability.

Where these came from

Every answer above was produced by DatumDesk.

DatumDesk answers Australian National Construction Code (NCC) compliance questions with clause citations, drawing on NCC 2022 and NCC 2025, state and territory variations, and ABCB handbooks. The commentary on this page is ours. The question, the verdict and the citation on each item are the published answer, verbatim, and the full answer with every source is one click away.

Questions architects ask

Before you rely on any of this.

Does DatumDesk cover the Design and Building Practitioners Act?

Yes. The NSW DBP Act and Regulation are in the corpus alongside the NCC, so a question about a varied regulated design comes back citing the section and the page, not a general note about compliance.

Which edition applies to a project that straddles 1 May 2027?

It depends on the state and the lodgement date. The ACT answer above sets out the election rule there. Western Australia has a 12-month rule for permit applications. New South Wales, Queensland, South Australia and Tasmania switch for building work on 1 May 2027. Adoption differs by state, so confirm with your state building authority.

Which NCC edition applies in my state right now?

It depends on the state and, in some, on the lodgement date. Victoria and Western Australia are on NCC 2025, with Western Australia allowing an election for NCC 2022 until 30 April 2027. The ACT allows either edition until the same date. New South Wales, Queensland, South Australia (for building work) and Tasmania move on 1 May 2027. The Northern Territory has disapplied NCC 2025 until the next edition. DatumDesk keeps a per-state status page at datumdesk.ai/ncc-2025 and every answer leads with the edition operative in your jurisdiction. Adoption differs by state, so confirm with your state building authority.

How are DatumDesk answers checked?

Answers are generated only from an indexed corpus of the NCC volumes, the Housing Provisions, state and territory variations, ABCB handbooks and referenced regulation. Every numeric value is cited to a document, clause and page. Practice notes are labelled as interpretive. Licensed Australian Standards are named and deferred to, never reproduced. Where the corpus does not hold the answer, DatumDesk says so instead of guessing.

Does DatumDesk replace a building surveyor or certifier?

No. The certifier makes the call and carries the authority. DatumDesk makes sure you arrive at that conversation with the clause, the edition and the page already in hand, and that your question is on the record.

What does DatumDesk cost?

DatumDesk Pro is AU$19 a month or AU$190 a year, per practitioner, with every feature on both. The first 14 days are free. Cancel any time from your account.
